    The Process Explained: Consular Processing vs. Adjustment of Status

    When it comes to obtaining a marriage-based green card or other family-based green card, there are two primary pathways: consular processing and adjustment of status. Consular processing involves applying for a green card from outside the United States, typically at a U.S. embassy or consulate in your home country. This option is often chosen by individuals who are not currently in the U.S. or who have a valid non-immigrant visa.

    On the other hand, adjustment of status is the process of applying for a green card while already residing in the United States, typically on a valid non-immigrant visa or if you entered the country legally. This option may be more complex, as it often requires navigating the intricacies of immigration law and ensuring compliance with various requirements.

    Regardless of the pathway you choose, the green card application process for spouses of U.S. citizens or lawful permanent residents generally involves the following key steps:

    • Filing the Petition: Your U.S. citizen or lawful permanent resident spouse will need to file a Petition for Alien Relative (Form I-130) with U.S. Citizenship and Immigration Services (USCIS).
       
    • Submitting the Application: Once the petition is approved, you will need to submit the appropriate application, either the Immigrant Visa Application for consular processing or the Application to Register Permanent Residence or Adjust Status (Form I-485) for adjustment of status.
