Understanding the Divorce Process

Divorce can be a highly emotional and overwhelming experience, but it is essential to understand the legal process and your rights in order to make informed decisions. Step-by-Step NC Divorce Guide

1. Establish Residency: In order to file for divorce in North Carolina, at least one spouse must have been a resident of the state for at least six months prior to the commencement of the proceedings.

2. Grounds for Divorce: North Carolina recognizes two grounds for divorce: 1) Incurable insanity for at least three years, or 2) Separation for at least one year with the intent of remaining permanently separated.

3. File the Complaint: The spouse seeking the divorce must file a Complaint for Absolute Divorce with the county's Clerk of Court. This document outlines the grounds for the divorce and any additional claims, such as child custody, child support, or alimony.

4. Serve the Defendant: The Complaint must be properly served to the other spouse, known as the Defendant, through personal delivery or publication if their whereabouts are unknown.

5. Respond to the Complaint: The Defendant has 30 days to respond to the Complaint, either by filing an Answer or failing to respond, which may result in a default judgment.

6. Discovery Process: Both parties may engage in the discovery process, which involves the exchange of financial information, depositions, and other relevant documents to support their case.

7. Temporary Orders: During the divorce proceedings, the court may issue temporary orders regarding child custody, child support, alimony, and the division of assets and debts.

8. Mediation: In some cases, the court may require the parties to participate in mediation in an effort to reach an agreement on the various issues before the final hearing.

9. Final Hearing: If the parties cannot reach an agreement, the case will proceed to a final hearing, where a judge will make the final decisions regarding the divorce, including the division of assets and debts, child custody and support, and alimony.

10. Final Decree: Once the judge has made their rulings, the court will issue a Final Decree of Absolute Divorce, officially ending the marriage.
